1. Introduction

Welcome to HuisPin. These Terms of Use ("Terms") govern your access to and use of the HuisPin website (www.huispin.com), browser extension, and related services (collectively, the "Service").

By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Description of the Service

HuisPin is a rental home alert platform that scans publicly available rental listings across major Dutch housing platforms. We aggregate this information and notify you of matching listings based on your search preferences via email, WhatsApp, and/or push notifications.

Important: HuisPin is an alert and aggregation service. We are not a real estate agency, broker, or landlord. We do not own, manage, or guarantee the availability, accuracy, or quality of any rental listing. Any rental transaction is exclusively between you and the listing provider.

3. Account registration

•You must be at least 16 years old to create an account.

•You must provide accurate and complete registration information.

•You are responsible for maintaining the confidentiality of your account credentials.

•You are responsible for all activity that occurs under your account.

•You may not create multiple accounts for the same person.

•We reserve the right to suspend or terminate accounts that violate these Terms.

4. Subscriptions and payments

•HuisPin offers paid subscription plans as described on our Pricing page.

•Subscription fees are charged in advance for the selected billing period.

•All prices are in Euros (€) and include applicable VAT.

•You can cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.

•14-day money-back guarantee: If you are not satisfied with the Service, you may request a full refund within 14 days of your initial purchase. This is in addition to your statutory right of withdrawal under EU consumer protection law.

5. Right of withdrawal (EU consumers)

Under EU Directive 2011/83/EU, you have the right to withdraw from a distance contract within 14 days without giving any reason. The withdrawal period expires 14 days after the day of the conclusion of the contract.

To exercise your right of withdrawal, you must inform us ([email protected]) of your decision to withdraw by means of a clear statement (e.g., an email). We will reimburse you within 14 days of receiving your withdrawal notice, using the same payment method you used for the initial transaction.

6. Acceptable use

You agree not to:

•Use the Service for any unlawful purpose or in violation of any applicable law.

•Attempt to scrape, crawl, or automatically extract data from the Service.

•Reverse engineer, decompile, or disassemble any part of the Service.

•Share your account credentials with third parties or allow others to use your account.

•Use the Service to send spam, unsolicited messages, or harassing content.

•Interfere with or disrupt the Service's infrastructure or other users' experience.

•Use the information obtained through the Service to discriminate against any person.

7. Intellectual property

All content, trademarks, logos, software, and design elements of the Service are the property of HuisPin or its licensors and are protected by intellectual property laws.

You may not copy, modify, distribute, or create derivative works based on our Service without our prior written consent.

Rental listing data displayed on the Service is sourced from third-party platforms and remains the property of the respective platform operators.

8. Disclaimer of warranties

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law:

•We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

•We do not guarantee the accuracy, completeness, or timeliness of rental listing data.

•We do not guarantee that you will find a rental home through the Service.

•We are not responsible for the actions, content, or policies of third-party housing platforms.

Our alert speed, scanning frequency, and notification delivery are provided on a best-effort basis and may vary depending on technical factors.

9. Limitation of liability

To the maximum extent permitted by applicable law:

•HuisPin shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

•Our total liability for any claims arising under these Terms shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

Nothing in these Terms excludes or limits our liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded under applicable law.

10. Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal data. By using the Service, you acknowledge that you have read and understood our Privacy Policy.

11. Modifications to the Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or a prominent notice on our website at least 14 days before the changes take effect.

Your continued use of the Service after the effective date of the modified Terms constitutes your acceptance of the changes. If you do not agree with the modified Terms, you must stop using the Service and cancel your subscription.

12. Termination

•You may terminate your account at any time by contacting us at [email protected] or through your account settings.

•We may suspend or terminate your access to the Service if you violate these Terms, with or without prior notice.

•Upon termination, your right to use the Service ceases immediately. We will delete your personal data in accordance with our Privacy Policy.

13. Governing law and disputes

These Terms are governed by the laws of the Netherlands.

Any disputes arising from or relating to these Terms or the Service shall be submitted to the competent court in the Netherlands, without prejudice to your right as an EU consumer to bring proceedings in the courts of your country of residence.
